Payment of Monies Owed From Decessed Mother's Home From Sister

My jurisdiction is: New Hampshire

Hello, my sister Ashley and I recently lost our Mother to sudden death Feb. 19, 2008. Our Mother named Ashley exeutrix of her estate. Which I was fine with. Our Mother's home has been assessed at $ 210000.00 at the time of her death. Ashley sold her home in Wilton and moved into our mother's home in Milford with my wishes. I signed my portion of the deed of Mom's home to Ashley, she did some very nice internal renovations to Mom's home. Ashley has not paid me my half of our mother's home as of this timeframe. I have nicely asked her about looking into a loan twice so far. In response, she said she has been looking into different loans in the Milford/Amherst area. She said the interest rates were high, and she will have to pay $ 1000.00 or more a month for payments. My sister did say that she would have to speak to her lawyer, reason being, she has a 4 yr. old son she wanted to make sure his future is secure. That is fine, but, what about me? Any advise?

Did Ashley fulfill her duties as executor? As executor, Ashley had a duty to make sure you got your share of the estate. If she doesn't, she can be compelled or removed as executor. I assume she did since you had "a portion of the deed of Mom's home".

So after Ashley discharged her duties, you signed your portion of the deed over to her. What was your arrangement for payment?

I would like to thank all of you for viewing! In response to dee_dub's questions, our mother appointed Ashley as the executrix to her estate. Ashley did fulfill all of the responsibilities and obligations she that was expected of her. Ashley did ask me what I wanted to do with my portion (financial) of the of our mother's home. I had mentioned to Ashley I would like to have her pay me my portion of the home when I was interested in purchesing a home of my own. I did not think about the interest I could be earning in the meantime. That is when I first spoke to Ashley about my reasoning for wanting the monies.

I assume that you have nothing in writing so you have nothing. Don't expect to ever see any money.
