Paycheck being withheld???

I was formerly employed by a hotel in Mississippi. This hotel has a "rewards program" that the member guests can participate in to accumulate points that can be redeemed towards free rooms, gift cards, etc. When I would check-in a guest into the hotel, if they didn't want to become a member, I asked them if it would be okay to carry them on my account. All these guests were fine with this. However, upon an audit, ownership informed me that this was theft and that I needed to pay the money back (hotel has to pay for points issued out) and I needed to tender my resignation. Although in my mind, I felt no wrong was done, I resigned, AND paid back the full amount to the hotel. However, now I am being told by hotel management that the Mississippi Employment Commission told him to NOT pay my my final check until we resolve "legal" issues.

What legal issues could there be? Can they press charges for theft if I have paid the money back?

Is this legal to withhold my paycheck that I have performed services for?
