Pay dispute with my previous employer

Hi,

I came to USA on H1B visa through ABC company. That company did not pay me as per my LCA and petition. They mentioned $75,000 in the LCA and gave me $68,00 for 10 months. I asked many time to pay me full amount but they did not give. Finally, after lots of effort they got agreed to pay me the actual amount after 10 months.

They did not flow the proper document LCA/Petition for paying the salary.

Now, i quit that company and they are not giving me my experience letter.

can i take any legal action?
 
FYI, Experience letters are only required by law in a very few states. VA is not one of them.
 
Agree, you can ask for a letter but they do not have to oblige (send you one) in your state.

Opening a can of worms here but I have a question for you. The 75k would be for the year so I don't understand how they didn't pay you the correct amount for 10 months. Also, they only had to pay you the prevailing wage to meet the requirements of the LCA, so if the prevailing wage was lower than 75k/year, you didn't have a valid complaint to begin with. If this is all correct, you may have shot yourself in the foot on the experience letter over a few thousand dollars.
