Paternity Fraud and Child Support

I filed for divorce from my wife and during the process decided to test paternity (as I had some doubts). I did the test (not court accepted) and found out she wasn't mine. During the divorce she signed multiple documents saying she did not wish to challange this test and accepted the results presented, I also signed a form relinquishing all my parental rights. Now she has moved to Utah and is threatening to sue me for child support. My question is where is the jurisdiction here in her state of residence CO or in the new state she moved to UT? Also does she have a case against me? What should my next step be to protect myself? Can I in turn sue her for paternity fraud?

If the court did not accept the DNA test then how did you relinquish your rights? Are you sure you you did this? You need an attorney to make sure paternity gets legally disputed. Depending on how old the child is, you may or may not be able to do this this late in the game. Most states have a deadline on disputing paternity. If you are still the childs legal father then you may get stuck paying child support.

This is sort of sad all around. Mom lied, and you now want to dump this child. If you had doubts the child was yours you should have had a test done immed. after the birth. And do you even know if the DNa test was accurate if it was an at home one?
 
She will probably file in UT but you can contest jurisdiction. You need to talk to your attorney to find out the exact status of the previous court order.
