I live in AZ & we share time with my daughter. He moved with our daughter more than 100 miles away on 12/1 without notifying the court & I was told on 11/25. We have a current case going to trial on 12/17 & recently had a parenting conference on 11/27. The current order states that I am to have her Mon, Tues & every other weekend, which the judge had to enforce on 9/28 because he was not following it. They moved on my weekend and at the parenting conference he stated that I wouldn't see her till January, and he would not agree to anything between then & the trial date. Although an area of agreement (pending judge's orders) was that we would alternate weekends & he would drop her off Fri at 6 & I would return her Sun at 6. I have filed access interference reports with the police department for the times that she was supposed to be with me. Now he wants to bring her down today (Friday) and wants me to bring her back on Sunday. Although this is still against the current orders. My question is: This should be my weekend From Fri to Tues. Do I tell him that he has to pick her up on Sun & take her back since she should be with me till Tues & there are no orders that state I have to do that? If so, he probably won't bring her at all. Or do I just bite the bullet & take her back on Sun? I want to do what's best for her, but I also want to keep within the law & my rights. HELP!
