own custody agreement

If my husband and i divorce, and we work out on our own regarding kids's arrangement, should we get a lawyer to put into writing
(i'm afraid he will change his mind etc.)? becuase my husb has agreed that i could have my son mon-fri, then he sat/sun. if it is in writing, then can i pursue him legally if he does not follow our intial agreement? also what's the differnce between separation and divorce? thanks
 
If you and your husband agree, why dont you go to mediation instead? Unless this agreement is signed off by a judge, it is not legally binding in court. What state are you in? a divorce is final, a seperation isn't. Agreements like this are really not a good idea because one person will often not follow through. Most states offer mediation during a divorce and if you and him agree on things, you might be able to do this.
