I worked for a company for 12 years and left it in June of 2008. I recently, 2 days ago received a notice that I had been over paid for three days of vacation. Is there a limitation to to the time a former employer can claim overpayment? Also the dates they are claiming overpayment are for days I was still employed with the company.

In Texas you have two to four years to bring such claims.

But, there is nothing they can do to you, anyway.

I suggest you tear up all revenue demands from these idiots.


Do not comment about the matter to these people, other than to say the following: "Under advice of counsel, I have been advised to make no comment about this matter, other than to say I do not owe you anything."

In Texas, your wages can not be attached or taken by legal process unless it is for child support, back taxes, or for money you owe a government entity.

Texas is a debtor friendly state.

They can't touch you (or your money) for their mistake, if that is even what happened.

Unless, the former employer was a local, state, or federal agency; you need not worry about these idle threats!
