Overpaid by $4000...what to do?

I quit my non-profit job in April 2008. I got a call form them 2 weeks back saying i am overpaid $4000 and they want their money, and that i can make arrangements if needed.

my husband recently has a heartattack and i honestly have not kept track of anything. i however made one payment of $987 a week back.

today i get a certified letter (not even on letterhead) from them saying that i owe them all the money by sept. 12 or i can make arrangements... if not, they will take legal action.

who is liable and can they actually take such action??
i can honestly only afford $100 a month now
 
You are liable and; yes, they can take such action. If they are keeping tabs of their money but you are not, it is not their fault. You must respond to the letter explaining what is current financial situation and like they have said, make arrangements. Communication is key here! Good Luck!
 
Since they are allowing you to make payment arrangements (which they are not required to do) it would be to your benefit to make the call and set them up. Perhaps they will be agreeable to $100 a month as long as you make the payments regularly.

Hope your husband is better.
