Your rights under OSHA should probably not be compromised at all by a non-compete agreement. I assume you mean non-disclosure because that deals with confidentiality while a non-compete deals with potential employers. An non-disclosure should not violate law which, if you've got an OSHA issue, you're dealing with federal law. An attorney can best answer your questions after a full review of all the issues in your case.
