Nursing Home Deduction

Patient is in a county nursing home. Patient or responsible party has always received a letter from nursing home stating amount paid for care/room/board etc. to give to tax preparer each year. Last year a new accounting person took over at said nursing home. They gave two different responses as to why these letters were not given this past tax season. 1) They should have never been given out in all the years past. The previous accounting staff was wrong in doing so. 2) Obama changed the law and you can no longer deduct money paid for care/room/board etc. on your taxes.

What is the correct answer?????
