I separated from my husband in February of 07 and I haven't filed for anything, my "husband" has a notary which has our mutual agreements. I read the info beforehand, but I want to know if because he intitiated the notarization, if it will affect me in any way. Or if he can he use that against me in the future. He wants something written that specifys the visitations. He also mentioned that once we have something notarized, the divorce process will be less of a hassel. Is it okay to sign?

Probably ok to sign but this does not replace going through the courts. if there are no court orders this may be hard to enforce should one of you decide you no longer want to cooperate.

Q: When I do decide to file through the court, can the court decisions overwrite the notarized documents?

A: Yes; notarization is not magic. All a notarization does is say that somebody signed something. If, however, the custody agreement is fair, the court may accept it.
