I'm not really sure where to start. My husband and I have been married for barely 6 months. I have read CA law on annulments and want to know where the courts come up with definitions. Do they look at circumstances on a case by case basis? Each relationship is different and based on their own definitions of certain things. I have researched and found a common opinion of the CA courts being that an intent not to terminate a sexual relationship with a "significant other" goes to the "very essence" of the marriage relationship and thus is sufficient ground for a judgment of nullity. My question is that my husband has a porn addiction...there are many "significant others" and his relationship is sexual in nature in that he pleasures himself. Might this qualify?

No, generally your husband masterbating is not a reason to divorce however CA is a no fault state so you do not need a reason. Annulments to require specific grounds, it is in your best interest to see an attoreny about this.

On another note, some sort of porn is normal in a relationship. Most men look at it at one time or another. Are you both willing to see a marital counselor over this, rather than run to divorce court?
