Not being paid at all

My husband got rehired at his previous job that he had worked at for 2 years, after being laid off from another job. After working for a few days he was told that he hadn't been "put in their systems" and needed to go home immediately and wait until his paper work was done so he would officially be rehired. They let him come back a few days later and everything seemed to be fine.

The next month I was hospitalized and had to have two surgeries so he took his FMLA and was out of work for 14 days. On all of his check stubs and in his system at work it showed that he had almost a full paycheck's worth of vacation time. He is paid on the 15th and the 30th of every month. He got a full paycheck during the time I was in the hospital and it had no vac. time deducted and said still that he had around 80 hours total vacation time left.

On his next payday we got nothing, not a cent. He called his payroll and they told him that they had made an error and he did not have any vacation time ever and that he would not be paid for the days he had missed. They also told him that they had "over paid him" although they wouldn't say when or how much. In addition to that they told him that he needed to "repay" them for all the time he had been gone in between quitting and being rehired. (It was 6 months time, so he has to work for free for six months???) None of this made any sense to us. We didn't know what to do, but figured if he had no vacation to be paid for there was nothing we could do.

So we thought we would be ok for this paycheck since he was paid nothing at all on the last one we should be even now minus 3 days that he missed for this pay period. But no, his check came and it is about $500 short. On the stub it says he is being payed for 40 hours of work, but the amount payed for that is only $116 which is totally wrong since he makes over $14 and hour. It should be about $570. ALSO it says they are paying him for 30 hours of vacation, which is weird since last month they said he had no vacation hours. This is killing us financially, and we cannot afford a lawyer and are also worried if we do anything it could cost him his job which would be horrible since he just got it back after being unemployed for six months.

He has spoken with his supervisors, who have tried to contact HR. HR will not return their phone calls or tell them anything and so far all that we have learned in this whole mess is that the thing screwing everything up is that when he was rehired he was put in their "systems" as not only a rehire, but also that he was on an extended leave for the 6 months. So basically, they are paying him the rate of a rehire (1.00 less that he was payed before) and they are trying to make him pay back the time he was gone and not give him vacation hours that a rehire would recieve, which I don't get because it wasn't like he was payed for 6 months without working or something. He talked to HR today himself and the woman flat out refused to help him or fix the situation or do anything at all. We have no idea what to do. The company is a HUGE institution, you can't get online without seeing their banners everywhere, but they are totally jerking him around. Any advise at all is appreciated, even to tell us where to find an affordable lawyer if that is the route we should take.

Sorry this is such a ridiculously long post and thanks to anyone who stuck with it and can give us some advice.

Nancy
