I took a day off to find a new job and notified my boss of my intentions and we discussed why I wanted to leave. I told him I wasn't quitting just interested in finding a new job. When I returned to work today, he sent me home claiming there was no work, yet the other employees were allowed to stay and I have nine years seniority over them. I believe he is being spiteful and trying to hurt me financially and emotionally. Can I sue him for this? He won't fire me and I can't get unemployment, but he can restrict me from coming to work. Is that legal?

No, you can't sue him. He did nothing illegal. Telling your boss you are taking a day off to go look for another job was not wise.

However, not officially "firing" you does not mean you can't file for unemployment. How long has it been since you had any hours?
