No credit for time served?

My fiance' was arrested on Nov. 15,13 for non-child support and will have served 58 days by today, his sentencing date Jan. 13,14.

His lawyer came to him with a plea bargain for 90 days and 5yrs probation. But, he was given NO credit for the 58 days he has already served, while waiting to go to court and his 90 days starts today.

Is this legal? What did he serve 58 days for, if not to be applied in some way to his sentence.
 
He served 58 days for not paying his child support. Nothing in the law says a plea bargain MUST include time served.
 
He might have been lucky to get a plea bargain of 90 more days & 5 years probation.
