Through our divorce, I recieved residential custody and he got visitation and the full summers in 2003. Having some time between us, my ex husband and I decided to try our relationship once again and I and our two children ages 13 and 8 moved to Boston, Mass to be together as a family once again. After six months I realized that he was an ex for a reason and I moved to Charlotte, North Carolina in July of 97. The children already spend the summers with my ex and since I was moving to a new state we signed a notorized letter stating that he will have temporary custody of our children until June of 08, and that they will not move out of the state of Massachusettes. Since then, he has not only moved to Greensboro, North Carolina and just told me yesterday, but now he won't "allow" me to have the children visit Charlotte for over night visits until he has something in writing.
We never went to court to to do temp custody, and now the notorized letter is voided. I need some advise on how I should handle this situation. Can he prevent me from bring the children to Charlotte for over night visitation, when in actuality I have residential custody?
