Have found out recently that in New Mexico, there is no legally recognized seperation. The petitioner has already filed for divorce and the respondent has been served, yet has yet to file her response. They own a fairly decent size of business/residential property together and she is trying to buy another piece of land, using funds supplied by a third party inheritence, to move into so that the currently shared property can be sold and divided. At what point does the community property deal end, and can he lay claim to half the new property under community property laws?
