Neglect?

My daughter has severe asthma. Her dad's girlfriend is a chain smoker and refuses to not smoke around my daughter. Currently, my daughter is living with my ex due to an old custody order that we had modified but never recorded at the court house (my stupidity). When my daughter was living with me (in a smoke free home), her asthma was under control. She was on steriod breathing treatments three times a day, plus a liquid steriod once a day. The day my ex decided he wanted my daughter (only because he got child support papers in the mail) he filed an ex parte order and I was ordered to give her back. She has been there for a month and I haven't been permitted visitation until this past weekend. I ended up taking her to the hospital due to her asthma being bad again. My ex is fully aware of the severity of her asthma yet does nothing to help her. My daughter told me that she does not get her breathing treatments and that the girlfriend continues to smoke in front of her, even though my daughter tells her that she can't breathe good when she is smoking. I gave my ex the hospital discharge papers and two perscriptions which he just blew off saying that he had this stuff at home (he never even looked at the papers or perscriptions). Our hearing isn't for another three weeks, isn't there something that can be done to prove neglect on his behalf? My attorney doesn't seem to understand how bad the situation is with my daughter's asthma. It seems like everyone understands the asthma issue but nobody understands how severe it is. Please help!!
