Needing custody back.

First off let me say I do not know where my custody as a mother stands. I just turned 18 and am on the mission to get my daughter back. April 2007 my mother called DFCS on my husband and I, for no reason, and yes, we know it was my mother-she flat out admitted to it. My husband is not her biological father--and I am the only one of her birth certificate (so I am the sole one trying to seek my custody back). We passed the drug tests+the 1 and only home inspection. We never heard a word from DFCS again. My mother was watching my daughter and asked me to sign a paper for her to take my daughter for her doctors appointment. Being 16-17 at the time, it seemed legit to me. Of course, now I know it was not. I have NO idea what the paper was nor do I have a copy. Once I signed this paper, I have never heard a word from my mother, have not seen my daughter. Have tried to contact them but the number has now changed. I have not tried to go to "grandmothers" house for fear of her calling police, etc. DFCS closed the case and have been of no help to me at all. I went to the courthouse and checked with the Superior Court Clerk who searched my name & my mothers name to see if anything was ever filed-nothing was. Went to the Juvenille (sp?) Court Clerk and they checked my daughters name/birthday-nothing again. Apparently nothing was ever filed with the courts because it would have shown up considering their files in the computer go back to 1980. I posted on another forum and everyone said "Call the police and go and get your daughter."..I do not think this would work, I do not know what the paper I signed was and I am sure DFCS probable has a copy. I do not know if it would prevent me from getting my daughter. Take into consideration that the paper I signed would be over 12 months old. Any advice or suggestions are greatly appreciated. I know this story is complicated. I am just trying to figure out what my next step should be in getting my daughter back. **I've been trying to do my research online and if I am right (know I might not be)--if my mother truley had custody wouldn't there be something, anything filed in the court system,or even a court hearing..I have heard NOTHING from DFCS,a court-anything!??**

I think you received good advice. Grab the birth certificate, get the police and go get your child. If your mother has some sort of paper giving her custody or guardianship, you will certainly find out then. I think it's unlikely that she has anything that proves she has any rights to your child.

Or, contact an attorney. Maybe a letter from an attorney will convince your mother to be more cooperative.

But, you need to do something soon. It's already been over a year. If you haven't seen your child much or regularly in that time, your mother could claim that you abandoned her. So, get on it tomorrow!!!
