Need to know what to do!!

I have custody of my 10 year old daughter, she goes with her dad every other weekend. Here's the problem, her dad's girlfriend is doing drugs in front of my daughter and her dad is taking pain killers non-stop. My daughter does not want to go back to his house. She does not want to be around it or them. I have talked to her dad about it and he says what goes on in his house is none of my business. Which in a sense is true, but when my daughter is there it is my business what goes on in his house. Can I call children services to go out and investigate? Can I have my daughter's dad and his girlfriend drug tested? I do not really have the money for an attorney at this time. I want to know what I can do to protect from child from this. Also, the dad's living arrangements are not up to par. Can that be used against him.
 
You have two actions I suggest you take.

1. Yes contact CPS and let them talk to your child, alone.

2. Drag Dad back to court and modify visitation perhaps to supervised visits only.
 
If I contact CPS will they take my daughter away from me? I have a nice home and she is very well taken care of here. I know her dad will not go for supervised visitations. What will the CPS all do?
 
Don't panic this has nothing to do with you. Your not doing drugs in front of the child. Doesnt matter if Dad likes supervised visits tough. If court orders them due to his and his GF drug use thats what he has to deal with. This isnt about anything other than the safety of the child
 
I am going to call them, I appreciate all your help. I just want what is best for my daughter. Can the CPS order them (dad & GF) to a drug test?
 
You can go to court and ask that dad and his girlfriend be drug tested and hope a court orders it. As far as living conditions, not sure what you mean but unless the house is totally disgusting and not livable, you may not get anywhere with that.
 
and CPS is probably not going to do anything unless the house is totally filthy, and the child is being neglected or abused. You would have better luck taking Dad to court.
