Need help with ICPC in OH

The mother, who is my niece, agreed to terminate rights to us but now DHHR is giving us the run around since we have an approved homestudy from WV. It seems the attorney for the State is very friendly with the current foster parents and she realy wants them to adopt. We finally filed for Permanent Custody- the final hearing is Feb. Is there anything else we need to file for or need to be doing? We visit 1x a week. Is the Federal Family Adoption Act on our side considering we are family? The child is 18 months and has been in foster care since birth. DHHR has tried to block us so many times- they took 6 months to get the ICPC to WV, they neglect to send us relevant court papers, i.e. the last court hearing changed venues from the Magistrate to the Judge on record so we were late for the hearing beause we were on the wrong floor- it was almost dismissed because we weren't there. Thankfully we found out and rushed into the courtroom at the last minute! We have been working with this since Feb. 2009 yet the attorney and caseworkers act like the delays are our fault! It is so frustrating. We already have custody of another niece through OH (3 years now- she is 15).
We have spent so much money on the homestudy, traveling back and forth every week, hotels because they "forgot" there was a visit so we have had to stay over night and wait to visit again! I just don't understand how they can do this!

The mom has no say on who she terminates rights too, she is unfit anyways. Who has had the child now? If the child has been with the foster parents then they have bonded with the child and it is not unusual to allow them to adopt if DHHS allows it. You are really lucky to eve get any visitation witht the child and you are out of state. I am not sure why the child should be uprooted from the foster parents who have been caring for the child since birth and given to you. The child sees the foster parents as his parents and it would be detrimental for the child and the foster parents to hand this baby over to you. Where are you? WV or OH? It is really unusual a case will be transferred from one state to another.
