need advice with getting custody of granchildren

On January 2 2010 my daughter and her boyfriend committed a crime. I went and got their 2 kids and they have been with me ever since. I went and filed for custody because without it I can not get any kind of medical attention or support for them. My daughters boyfriend got his bail reduced and posted bail on Feb 16th. My daughter still remains in jail for I can not raise her bail money. Her boyfriend also went and filed for custody. My daughter does not want him to get the kids because she knows they will be better off with us. What are my chances of getting the kids.

Unless you can prove him unfit (by the courts standards - not yours), the chances of you getting custody are virtually nil. His rights as Dad by far supersede yours.

What was the crime?
 
the crime was they robbed a liquor store. He was the get away driver. He has no income to take care of the kids and never held a steady job.

The ne'er do well father is in better shape than her on this one.


He's also innocent until proven guilty.

She is, too!!!

He's out of the slammer and available to parent his kids.

Albeit, he'll probably be poor at it, but he is available.

Maybe you should work very hard at getting your daughter out of the slammer?

She can get her bond lowered, or even get out on her own recognizance.

Speak with her court appointed attorney about getting her out of there ASAP!!!

Sorry but your daughter still had a baby with an idoit and they both are troubled it sounds like. You need an attorney. It is possible a judge may keep custody with you. However, if you go on any sort of assistance, you will be forced to fle for child support which will sway the Dad to fight you for custody even more.
