We are in need of a lawyer that specializes in cyber law. There is a person that lives in MD that continues to harass us and uses our email address to sign up for groups on MSN. They have, also, accused one of us of horrendous crimes using the court system to harass us. Please, can anyone help.

Why not complain to Microsoft. How are they using the court to harrass you? It doesn't sound like a simple case nor will it be cheap. Are you willing to pay what it may cost to deal with this person? Sending a lawyer's letter might be the solution but I'd first send a complaint to Microsoft.

uses your email address? sounds like they probably have your password as well. Why didn't you change your password as soon as you noticed it had been compromised? have you changed all your other usernames/passwords?

Who is this lawyer supposed to sue if you don't know who it was that took your email address and password? How are they involving you in the court system simply based on an email address which you allowed to be compromised?

More details are needed.

Here is my guess -- they aren't using his account. They are signing him up to newsletters and marketing campaigns that don't require opt-in confirmations. These aggressive marketing tactics make it simple to sign up people who never intended to sign up -- and there is little control over opting out once they've received your email and "permission" to sell it to others.

Unfortunately this is very difficult to prevent. To find out who signed you up might result in talks with several ISPs, tracking IP addresses, collaboration between entities and the ISP of the account holder to reveal name and address. This can cost a great deal of money. I'm not sure there is an easy solution here.
