Name Change of Minor

I am a guardian to a 2 year old who is my niece. Her mom left about a year ago and her residence is unknown. Her dad is incarcerated as far as I know. The court has established me as a permanent legal guardian of her. How would I go about changing her last name to mine instead of her dad's who will never have any contact with her. I have a petition to change name for her that I have started. However, it is for one natural parent and not guardians. Can I change her name if I am the guardian?

yes you can chage her name-with her parents permssion. and it doesnt make you the parent. and how do you know dad wont have contact with her? she is his child, and he has rights. and you have no right to fibid his contacnt with HIS child. same goes for mom
