New York- i'm a married father of 2 children, a woman became pregnant with my child she is due in jan. . i have taken responsilbility for this child, i recently got laid off, while i was working i paid for an apartment for the mother i also paid for all personal and medical needs for her and the baby, while also paying for child care for my other 2 children. Now that i am laid off the mother wants to seek child support, have me pay all child care expenses, and continue to pay her rent. i'm not denying the child or unwilling to help with the childs needs but what are my rights on what she can get? she herself is unemployed by choice and doesn't have any future plans to return to work. she also pays chid supportfor a child no longer in her custody. i just don't want to end up fully supporting this woman if the money is not going towards the child. advice please?

Child support is not intended to fully support the mother and child. The mother should be imputed an income, even though she isn't working. You may also be imputed an income based on your previous salary. You should really consult an attorney.

You do not have to support mom. She needs to support herself. Actually you do not owe her anything until the courts tell you too, and paternity is established. Make sure this child is yours. What makes you think you are responsible for paying this womans rent? You are not. Stop doing it! Save that money and use it for an attorney so you do not get squeezed here. Stop feeling sorry for mom. It is not your fault she is unemployed. See an attorney about establishing paternity. An income should be inputed for mom as well. You may be responsible for part of day care but mom is crazy if she thinks she is going to get you to fully support her and the baby, especially when you have other kids to support and you are not married to her.

if she is going thru the attorney general all you need to do is write them a letter requesting a dna test before you go to court for child support. it sosted me 111$ to do it thru them. if you are on the birth certificate and dont have a dna test done you are automatically responsible for the child. but get a dna test anyway and let the court determan what you pay, then try to keep track of how your kids being taken care of for further issues, since she doesnt work. they take 21 percent of your income for a child, unless you have others to consider then its lower. it sounds like your spending way more than you have to. use the court it will be better in the long run for sure. thats how they do it in texas or atleast to me and mine.
