My Nephew need your HELP

My Niece has a 4 month old son. She has not been a good mom at all. My mother in law is raising the baby. She has taken wonderful care of him. MY niece has gone from guy to guy and is not residing with this one. She has been gone for around a week and a half now. She is threatening to come and get her son. The place where she is living is not suitable everyone there is on probation of some sort. There are 9 people including her living there. My niece has done nothing for her son but maybe the first week of his life. The social services in the county where we live is very layed back and not efficient in my eyes. She has abandoned her son this time in my book. My mother in law wants emergency custody of my nephew. There are so many people in our community that have told her to do this also. They all see what my neice is doing. Please advise us. I want to go to the courthouse tomarrow before she come and runs with him.

Well you already know what to do, your mother in law needs to file for emergency custody. With nothing legal from the courts mom can technically come get the baby.

where is dad? his rights to custody are superior to anyone else's.

and btw, if she does come for the child, and you refuse to let her have him, you can be charged with interfering with custody. which will most likely cause grandma to be denied custody
