I am a father of two special needs boys from Michigan. My wife and I are separated not devoiced living in the same house. We were thinking of filing for the divorce but she became pregnant with another mans baby. And was thinking of marriage to him and taking my boys, but hear is the problem. He is convicted of criminal sexual conduct 2nd degree (person under 13) and has to spend life on the list for sex offenders when he is done with his probation. I am not going to let that man be anywhere near my kids. Can I file for a restraining order now or after the devoice? Should I file for one? What kind of rights to his child (from my legal wife) dose he have?

Have you seen an attorney? The fact mom is pregnant with a sex offender and plan on staying with him should be good leverage for custody. Under no circumstance would I allow her to remove the kids out of state or allow them around the man. You should file for divorce and ask for custdoy and you certainly can ask for an RO on behalf of the kids since he is a threat.
