my girlfriend was a minor

since my girlfriend was only 17 and i was 19 (we had been togeather for three years) when our child was born, i was wondering if i should even try to get full custody of our son. there is no doubt that she will bring it up in court. i have no idea how the laws work in oregon pertaining to that matter. she wants to alternate years with our son, and i dont thank it will be good for him to move to a new town every year. on the other hand i dont want to get in trouble for having sex with a minor and loose my son all togeather.
 
No one can tell you if the judge will look on your child molestation in a good way or a bad way.

But I have my suspicions.
 
First of all it is not necessarily child molestation. You will have to look up the age of consent laws but a 2 year age difference in most states is not against the law. You are still the father of the child regardless. If you want visitation or custody go file for it.
 
There needs to be a three year difference for you to have charges pressed against you. The best thing for that child is for one of you to have primary physical custody and have the other have flexible and regular visitation. Both of you should stay in the same school district. Moving a child every other year would create very large emotional problems for that child and I do not believe, if you live in different school districts, anyone would ever allow it. The person who has the best childcare skills and family support should be primary care giver. There are many teen girls that are good mothers.
