I live in the state of California and wondering if there is a law against selling your parental rights? This is the second time my ex-husband has demanded money and in exchange he would relinquish his parental rights to our daughter so my husband could have a step parent adoption. Isn't this illegal?

Yes it is illegal. I would not pay him a dime. He either wants to be a father to the child or he doesn't. It is shameful that he wants to sell off his kid. Does he see the child or pay child support? If not I would still try to pursue termination of rights, you may be able to terminate without his consent if he has no relationship with the child. Document this offer if you can. I am a sure a judge would not be too impressed with him selling his kid.

In order to him to "sell" his rights there has to be a "buyer" tell him that you are saddened by his poor parenting skills and that he can pound sand.

Spend your money on an attorney. File a Petition to Terminate his parental rights. His actions will not impress a Judge. I would imagine the Judge will terminate his Parental Rights as being in the best interest of the child.

Thank You. Do you know exactly what law he is breaking by trying to sell his rights to my daughter? Any help would be appreciated.

He isn't exactly breaking a law by trying to sell his rights to the child. While he cannot sell his child, he isn't offering to sell you the child but his rights. It is no less disgusting for sure but there is a slight difference. I would move to terminate his rights. His actions tell me he probably has several grounds that would allow you to sever his rights. Abandonment, failure to pay child support, emotional abuse, and in that context selling his rights or attempting to would make him look very bad.
