My boyfriend came here from mexico with a visa but did not return to mexico when his visa expired. We have a 2 month old baby together and want to get married and make him legal. You should speak with an immigration attorney.
As anyone can see, immigration law is growing more unstable everyday.
The immediate problem for your BF is two fold 1 - He's here ILLEGALLY today; 2 - He's just your boy friend

My guess is that becoming LEGAL in his condition won't be difficult.
