Hi,

I have an 11 year son and a 9 year old daughter. My wife and have been seperated for a very long time and haven't had any kind of court order to define custody and visitation.

She is essentially keeping me from having any kind of consistent meaningful contact with them. My boy is haveing trouble in school and I want to help him, but she won't allow him to bring his work when he comes to stay with me. As a result I have no idea what he needs and can't effectively be of any assistance. Can she keep them from me this way?

I work on the road on the weekends and have to settle for a couple of hours one day a week. Except for when I happen to be off a weekend. I live about 40 miles from them and she's refusing to allow anymore than that.

Any help would be greatly appreciated.

No, she can't. But to force her hand you will have to hire a lawyer and file for a legal separation and fight for satisfactory visitation agreement. You can contact the school and his teachers all you want to as long as there isn't a restraining order against you or other court order prohibiting you. Talk to the principal, tell him/her your situation and that you want every communication that goes home to be copied and also sent to you (provide self-stamped addressed envelopes to teacher, principal, and front office.) Give the teacher(s) your email address as well as your cell phone. If your wife raises a stink, you raise a bigger one as it is your legal right to be kept informed about your child and she (wife) has no right to deny you.
