My 12 yr old wants to live with me

My son just turned 12 (June) and has vocalized his desire to live with me and my wife on several occassions over the past few years, even more so this summer. When my ex and I divorced 10 yrs ago, we were living in Mississippi. I transferred with my job and moved to live with my family in Georgia. However, I still made every possible attempt to see him and my daughter. About 4 years ago, their mother decided to move to Colorado. She didn't even mention it to me until after the fact with an, "oh yeah, by the way our new address is...." Now that they live so far away, I am only able to see them over summer vacation (I have to pay their way here in order to see them). My wife and I want very much to have him live with us. I don't even know where to begin in this process.

You start with the existing child custody-support order. Do you have one? What does it say? Who's the primary custodian? Where is that person supposed to reside?

Everything you are able to do should be in the court order. If it isn't, you're going to need an attorney. You'll probably need one anyway!

If you were divorced in MS, did the court know she took the child to CO? Why didn't you complain when she dud that? Most custodial parents can't relocate 1,500 miles away without the court's approval. Was that done?

By doing nothing for four years, anything you do now, might have to be done in CO.

your son can choose whom to live with when hes 18. the judge will take his wishes into consideration, but he or she decides. not your son.

WRONG.

Georgia is the ONE state where a teen of a certain age CAN legally make the decision of where s/he wishes to live.

(Between parental homes, that is)
