I live in Colorado, my ex is charged with Child Porn distribution, has a long list of DV that involved me. My ex only has supervised visitations with the kids, they are 5 and 8. We all want to move out of state badly and I would have greater opportunities for jobs. My 8 yr old is confused about his relationship with his father right now. He understands what is going on and why dad is in trouble. My ex filed an Emergency Motion to detain children, What are my chances? My fiance in Florida already has a good job and a very nice house for us. And thoughts? I'm desperate to get out of this state.

You need to prove the move is in the childrens best interest. If he has supervised visits only and you can prove the move is necessary then you have a shot. dad can still fight it. how will dad see the kids at all if you move? Be advised you might have to pay for transportation for visits and if they are supervised only that might cost you alot of $$. If he goes to jail then moving probably will not be so hard. Have you talked to an attorney?
