Mother trying to take daughter out of state

Hello...

My husband's ex-wife has recently confided to her ex-mother in law that she plans on taking their daughter back to California without consulting my husband. Apparently her new husband is on leave from the service and is based out of California and has recently been called back to service pending a physical.

According to the ex, she plans on using the excuse of being a "service" wife to get base housing, therefore, she needs to take their daughter with to be with her. Not only has she not mentioned this to my husband, but she has the financial means (by way of her mother) to look into this matter with ease.

Although they have joint custody, I have heard that the mother's usually have most of the rights and she will most likely be able to take the child, but I wanted to get some advice regarding this matter. Any help is appreciated!!!

Men and women are treated equally these days in child custody matters. The days of female preference (if they ever existed) are done. Fathers are as fit to be single parents as are mothers.

I'm not sure how the "ex" wife plans to take her child and do as you suggest. If she does, her ex-husband has legal remedies. Until something happens, people (nor the law) can't act on rumor and innuendo.

By the way, how can someone be on leave from the military and awaiting a physical (and processing) to go back in the military? I'm retired army (28 years), and that isn't possible. You're on active duty or you aren't.

Dear Army Judge,

My understanding is he was on active duty and got injured, then they got married in Nevada and has since be recalled. He does not want to go back, but she is pushing him to for the reason of what she thinks she can get. Of course unless she actually does something I have no proof, however, I want to take precaution. Thank you for your reply, I truely appreciate it.
