My ex was abusive I left... we were week on week off visitation with the children ages 3 and 5 at the time. I didn't have a place to stay.. when I left he took my car so I lost my job I asked him to take the kids full time for 1 month give me a chance to find a home get a job and get on my feet. He used that time to file for custody using an address he knew I didn't live at for the courts so I was never notified. Life was rougher then I expected and I didn't get on my feet really financially able to care for the children until this year... he was awarded custody and worded it so I have visits with the kids "supervised" by himself or another party to whom he agrees because he doesn't know where I live and doesn't beleive the children will be safe with me.
Bottom line.. it has been 2 years he won't allow me to see the children he won't allow me to speak to them on the phone even. I can prove we were in contact when the court case was going on and I wasn't even told, proving he lied to the courts should I file a motion to vacate the order and try to start fresh or should I just try to get the visitation changed and then go for full custody. BTW he is abusive he has at least one case filed with child services he is NOT the model father he claimed to be in his case against me.
