Mother left state with child.

My nephew's wife left the state with their son to visit her family. Now she says she's not happy and is not coming home. Is this leagal? How should he go about getting his son back?

He needs to file for divorce and custody or return of the kids ASAP while his state still has jurisdiction. Once mom meets the residency requirements in the new state she can file there.

He should see an attorney asap or go down to the courthouse and file on his own.
