My husbands ex wife keeps takeing him back to court for doctor bills. He agreed in devorce over 10 years ago to pay all doctor bills and since then about two years after devorce his son became a dibetic. The doctor bills alone are killing us because his is paying 100% He has been getting behind on both child support and medical. He was currently laid off from work and the judge still request that he pay 381.50 for child support and 118.00 a mounth for past medical. He currently has started a part time job and makes extremly less money but the judge refusses to deduct his child support. How can this be fair? NOt only that, we have been going over past court orders and child support reciepts and found my husband has been over charged by his ex wife. And she has also lied in court about bills that had together that he was suppose to pay off such as taxes and credit cards. Well the judge made him pay her over 3000.00 dollars, just for us to find out later that she never payed the bills with the money she recieved.What can we do about this?What is his leagle rights?

Has your husband actually filed with the court to modify the child support order based upon his lower earnings?

Or did the judge keep the order based upon your husband's potential earnings?

Did the judge specifically order the ex to pay those bills, or simply order that your husband pay her the money?
 
He keep childsupport like it was based on potiental earnings but he was in the construction field and there is no work out there right now and also the judge ordered him to pay her the money for bills they had together and she did not pay bills we have documentation to prove this.
 
Then I'm sorry but there seems to be little recourse.

Unless the judge specifically ordered Ex to pay those bills as part of the actual court order the Ex hasn't actually done anything wrong, legally speaking.

With regards to child support, after a certain amount of time has passed since the original order was made he can once again file to modify. But I can't see it being reduced.

The court understands that just because he earns less, doesn't mean his kids need to eat less.

Now with regards to the other matter, when you say "overpaid", what exactly do you mean?
 
Most out of pocket is split 50/50. Dad should not have agreed to pay all. All he can do is go back and ask that it be split. If the judge has already declined a support decrease based on earnings capability then there are not many options.

Are you working? I only ask because you state that :
The doctor bills alone are killing us

Since you consider his legal situation to be "your own", perhaps your income should be considered by the Judge.
