Hello i'm in CA and this is our situation. We receieved notice 2yrs ago(2012) for a child support review, fillied out paper work sent it in and never heard back from the agency. Again last year(2013) we received the same notice again filled it out sent it in but now received a packet stating we have to appear in court on this matter. In this packet they sent there is a letter stating the criteria for the support order to continue. His daughter did not, and still does not meet the criteria and we made the worker on this case aware of these facts and asked for them to be investigated and nothing became of that. She is 18, employed and NOT enrolled as a Full-Time high school student, which is the criteria. Is there anything we can do to fight this when we go to court? How can we obtain any of the documents to prove our facts? I thank you for your time and assistance.

You can request the court to issue a summons to the child's former principal, school counselor, or high school registrar and a subpoena to bring relevant documents to substantiate your premise and the expected testimony that Suzy Suchinsuch disenrolled from school on 15 Jan 2013.

You'll also be able to examine the adult/child under oath as to her school status.
