Misrepresentation of estate executor

Property owner dies & only his name on title. Property has large mortgage on it. I know that a person nominated to administer an estate can just not file probate and let the property go. However, if this person misrepresents themselves as an executor of the estate and collects rental money from said property, can they be charged with fraud?

Probably, maybe, depends, but you should report what you suspect (or, perhaps know) to the district attorney or the local police agency.
