Messy custody

I am a single mom who used to live with the father, me and my son left the home after a domestic violence situation in which i was the victim. CPS got involved b/c our son was in the home. The father is now wanting custody, in the past year he has paid me very little to help support our son. We were never married and he said he will not accept anything less than 50/50 custody, what is the likelyhood that he would get 50% custody? FYI, I in no way want to keep his son from him, I just feel that because I supported our son more than 50% since birth he shouldn't have that much custody.

Is there a child support order issued by a court? What state are you in? What was the outcome of the criminal proceedings?
