I was wondering I have a small claims case filed against me I have a date set for mediation is this mediation mandatory. As far as I am concerned there is no mediation to be had. If I was to not show up for this mediation hearing would the other party get a default judgement

You'll have to look up your own small claims court rules but according to the Washington County small claims court it appears that you can decline mediation.

But I suggest you don't just not show up. If you want to decline, check with your court and find out the proper way of doing so.

Scroll down to Mediation Hearing at:

Civil - Small Claims

Note that mediation agreements do not appear as a judgment on credit reports so it might be to your advantage to give it a shot.

There is no such thing as a slam dunk in court so no matter how strong you think your case is, it might not be, and you could easily lose and get a judgment against you with all the consequences that go along with it.
