Medical Malpractice Malpractice -Is spouse entitled to a portion

A friend of mine is settling a malpractice suit against a local hospital. He and his wife are getting ready to seperate. His lawyer is saying she is entitled to a portion of the money because it caused problems with the marriage. Let me interject here that she only went to see him 1 time while he was in the hospital. Is she legally entitled to a portion of this money? She didn't go through the pain and suffering, he did. She didn't even take care of him when he got home. A nurse came in once a day

What his spouse is entitled to depends very much on the facts of the situation. His attorney has a much better grasp of those facts than anyone here. It is entirely possible she is entitled to some portion of the money.
