I have been raising my baby ever since her birth on Nov 20, 2008. The father of my baby didn't want anything to do with her and we had to have a blood test for him to accept her as his child. When I went to court in March of 2009 to establish sole custody and place him on Child support, my child support cases were always put off because he claimed he couldn't make it to court. He recently joined the Air Force and was stationed in North Carolina so that was his reasoning. His mother who lives in Virginia where I live constantly harrasses me about seeing my child now that she knows she's the grandmother. I even lived with her for a few months so she could be with my child. After several months of living with her, I moved in with my girlfriend and her mother for about a month and a half and then I moved to my current location where I have been since June 2009. My baby's father mother called CPS on me because she didnt think I was taking care of my baby since she hadn't seen her since she moved out. She then went down to the court and and filed for custody of my child on behalf of her son and her. I didn't make it to that court hearing because I was never served since the letter went to my girlfriends house and she didn't give it to me until after I was notified. The court in my absence granted them custody of my child. I already had custody of my child and was unaware of their custody. The father came into town last Saturday Sept 5, to see my child. I let him hold her and he drove off with my child in his hands without a seat belt or car seat or nothing. I called the police and they contacted him and he produced a paper stating that he has custody. So now I had to go to court to fight this on Sept 9. The judge that was presiding was the same judge that granted me sole custody back in March. He asked me who gave me custody and I told him the Judge that he did and would he like to see the paper work from that order and he told me "No he doesn't want to see anything" and then he asked if I wanted visitation rights, and I out of emotions told him No, i want my child back. He said I would have to return for a court hearing scheduled in January of 2010. I can't believe that, that could happen. I want my child back. Can anyone provide me with a solution. I can't wait till January and I feel that the Judge didn't want to hear my side when I have custody papers too. He told me that I don't even have visitation rights since I told him no. How could this be, I have been raising my daughter without child support since her birth and then the father to avoid paying support and his mother make up crazy stories to the judge saying that I was unfit, on drugs, and Lord knows what else they told the court in my absence for them to be granted custody. Help me before I lose my mind. Thank you!!
