My daughter is going to be incarcerated in the near future. Since birth, she has had my granddaughter and has supported her for the last seven years without child support. She is not married. The biological father has had no contact with my granddaughter since the day of her birth. We have gone to court regarding child support (it is over 10,000 owed now) and he challenged paternity and did not show up when the court told him to get a test. No one knows where he is and he has been in trouble with the law for years.
My daughters court appointed attorney (private attorney's are appointed in Chesterfield County) told her to transfer parental rights to us (grandparents). Can we do limited guardianship or guardianship? My daughter may be incarcerated for 2 years. A lawyer told us we only needed to draft a letter for limited guardianship and have it notarized? How does that work for legal issues.
