My jurisdiction is: MS
I apologize if you have received this a second time but I can't find it anywhere so I must have made a mistake. My daughter was denied legal services because they said that she makes too much money so we will try to go to family court ourselves. My Daughter's husband (he had told her that he annulled the marriage) has disappeared with their son for four years and now we finally saw an announcement of a court date in the paper a few weeks ago for Aug 24th filing for divorce and custody. the baby was born prior to the marriage and he did not want his name on the BC (???). He was a very nice gentleman until he found out she was pregnant and them proceeded to isolate her from everyone (he lied about his age and is quite older than she is, I'm still not sure of his exact birthdate), I would go to visit and we would stay in one room of the house or if we went out it would have to be without the baby, when she finally had enough she left to west LA and came back with my sister, took the baby and started to set up residency there and start her life over. Isaac sued for complete custody, got in touch with her and talked her back into getting together. He moved to LA (which he did not state in the papers), opened up a business and married her. Five months later with her permission because they were getting along fine to everyone's knowledge he took the baby to see his parents in MS while she stayed with the store. He came back without the baby and took everything out of the store. I had hired a lawyer and paid up to $4000 before they got back together and had no more monetary resources. I went to his house with presents in hand to visit my grandson on his 2nd birthday and after numerous attempts to call to set up a time to see him. When I arrived the front door was locked so I went to the back door. They answered and asked me several times if I was alone. Lois, the grandmother then grabbed my arm and told me she thought I just assaulted an old woman. I was in shock and tried to release my arm from her. The police arrived and I was forced to go to the station and was told not to call, mail, or visit their house ever again. The Chief of Police told me they had that right and if I wanted to see my grandson again I would have to get a lawyer, I think he believed my story but said there was nothing more that he could do. I left my phone number and address and said that if anything happened to please contact me. Four years later after my daughter had tried numerous times to call their house and find out about her son I received a letter in the mail about the court date. Her husband's friend who has since parted ways with them sent the notice to me (he was also there to witness the 2nd birthday incident) and said he would help her. That's when we found out legal services denied the case so now I need to know what I should do paperwork wise to be prepared for court. I have never been to court except for jury duty and am pretty ignorat when it comes to the correct procedures. He is claiming adultery and habitual inhumane treatment or in the alternative irreconcilable differences, legal fees, child support and permanent care, custody with supervised visits. He is the one I would not trust to return the child upon the visitation switch. i don't want this to get ugly but I know they want to raise the child without my daughter and without vaccines or medical doctors. They had a fit when she got his first shots in LA, I think that's why he took the baby, If th friend will testify about the 2nd birthday incident that will prove they are not credible I hope. Anyway, any help in this matter would be greatly appreciated.
