Landscaper accused of leaving the fence open Animal Injury, Dog Bite

    Landscaper accused of leaving fence open and then a stray dog attacked the home owners pet.
    Landscaper employees claim they remember closing fence. Fence encloses complete backyard and the inground pool. Homeowner called to state fog is in the Vet over night and wife had to take 2dsys off of work. Is landscaper responsible?

    The landscaper denies leaving the gate open.
    If you can't disprove that, they aren't liable.

    There's no way for anyone to say HOW the stray dog gained entry to your property, unless you observed the landscaper's employees putting the dog in your yard.

    The owner of the other dog, if there is one, could be responsible.
