I have a friend who is going through a divorce her husband moved out of the home and is currently living with another women. My friend is living in the house and land that was purchased in his name during the marriage he is trying to get half of the money from the purchase or saying she needs to move out. Being a community property state can he do that?
 
There is no way to know. If there is going to be a dispute over property she would be better off with an attorney.
 
If he wants proceeds from a sale, and she can't or won't buy him out, it is possible a judge would order the home sold. But, the proceeds from such a forced sale are usually divided between the husband and wife. In this economy, such sale soften takeaway long time.

You might advise her to hire an attorney. Normally the attorney's fees will derive from the assets of the marriage. Essentially, the attorney gets paid through the marital assets, his money.
