I left my husband in 2004, with just clothes on my back, he had us in bankrupsy and they were taking my paycheck for this because he was self-employed. I left my 2 children with him because I had no money. He filed for child-support and a quicky divorce within 3 months of my leaving. When I tried to find legal help noone would and legal aid told me I made too much money even though I wasn't getting any of it. I finally had the bankrupsy dismissed without prejudice.
I went and tried again to get help for custody and finally did in 2006. We had a hearing in front of a Master in 2007, prior to the hearing we had to attend classes, I did and he didn't until after the hearing. The Master did not give his ruling until 5 months later, he kept physical custody to my husband with legal joint to me.
I immedintly asked for a trail de novo hearing, I finally got one in Oct. 2009. My ex-husband was ordered for a drug test which he did not take until 3 weeks after his due date. He also admitted to looking up how to pass it on the internet and claimed he hadn't done it since high school (he's 48). I also had a picture of my son doing a beer-bong with pop, told the court of my son shooting a gun out a window with no adult present and how my son ranaway.
My children ages 13 and 15 told the judge that they wanted to live with me and my fiance of 5 years. We have no criminal records, both have jobs, and my kids say they are more comfortable here.
In this hearing, my Ex-Husband still has physical custody and I have been ordered to transport my children to a specific church and church activities.
My husband a the sister and priest testify on his behalf and the judge made committ that she has holiday dinners with the sister. (My order came down in Dec. after Thanksgiving)
It also states that I get them every other week in the summer. I have to wonder if this has to due with my employment, I work for the hospital and alternate from daylight to midnight shifts.
My kids are very upset that they told the court how they feel and want to hire a attorney for themselves and I feel this should've never taken this long and that there is a lot of bias here.
