Job elimination laws

I was recently laid off from my employer. I was told my position was being eliminated. I received a severance package. I was part of a larger group of layoffs. 30 days after my last day, my position was "filled" with somone internally. If my position was eliminated, isn"t this illegal?
 
No, it's not.

A lot of people misunderstand what is meant by a job elimination. It is a headcount issue, nothing more. It doesn't mean that they no longer need to have your duties done; it means that there will be fewer people doing them. A lot of people assume that since someone internally picks up their duties, it means that their job was not eliminated and they translate that to an illegal termination. But chances are pretty good that the person who is now doing your former job, is also doing their own former job as well.
 
The person assuming my position is a returning expat. Does that matter or is it still just a reallocation of headcount as you described?
