Alcohol & Drugs: MIP, MIC, Intoxication Is this right

If I was a passenger in the backseat and sober , yet my driver was not ;
is it fair they arrested me for questionin,. gave paraphonalia back to passenger in front
also , let them drive away ,. I had no warrents at this time .Confused ?
